This Privacy Policy (the "Policy") describes the manner in which JackPotHQ LLC ("JackPot," "we," "us" or "our") collects, uses, discloses and otherwise processes personal information in connection with the JackPot mobile application, the website located at jackpothq.co and any related products or services that reference this Policy (collectively, the "Service"). This Policy is incorporated into and forms part of our Terms of Service. By accessing or using the Service, you acknowledge that you have read and understood this Policy.
1.1 JackPotHQ LLC, a limited liability company organized in the United States, is the business and controller responsible for the personal information described in this Policy.
1.2 "Personal information" means any information that identifies, relates to, describes or is reasonably capable of being associated with an identified or identifiable individual or household.
2.3 The mobile application does not incorporate third-party advertising technologies and does not track users across applications or websites owned by other companies.
3.1 The Service requests access to device functions only when you use a feature that requires such access. Each permission is optional and may be modified at any time through your device settings. Declining a permission will disable only the associated feature.

5.1 The Service uses artificial intelligence models, including models provided by Google LLC under the Gemini brand, to generate recipes, Recipe Browser results, Pantry suggestions and Dinner Party menus. In connection with each request, we transmit only the information reasonably necessary to fulfill it, which may include serving size, meal type, dietary preferences, allergies, relevant Pantry items, Recipe Browser search terms and Dinner Party descriptions. We do not transmit your name, email address, telephone number or payment information in connection with such requests.
5.2 We do not engage in automated decision-making that produces legal or similarly significant effects concerning you.
5.3 Artificial intelligence output may be inaccurate or incomplete. JackPot does not warrant that any recipe or menu is free of any allergen or suitable for any medical condition. You are solely responsible for reviewing ingredients and product labels. The Service does not provide medical, nutritional or dietary advice.
6.1 We disclose personal information only as follows:
6.2 We may use and disclose information that has been aggregated or de-identified such that it can no longer reasonably be linked to an individual or household. Recipes generated or retrieved in response to searches may be stored in a shared recipe library and made available to other users, without any information identifying the user who performed the search. We will maintain such information in de-identified form and will not attempt to re-identify it.
7.1 JackPot does not sell personal information and does not share personal information for cross-context behavioral advertising, as those terms are defined under applicable law.
7.2 Should JackPot intend to sell or share personal information in the future, we will amend this Policy and provide notice before doing so, make available the opt-out mechanisms required by law, and will not sell or share personal information collected prior to such amendment without your consent.
8.1 Where you grant contacts permission, the Service reads the names and telephone numbers stored in your device's address book. Only telephone numbers are transmitted to our servers, solely to identify matching accounts. Contact names remain on your device. Unmatched telephone numbers are not associated with any profile, and contact information is not used for marketing and is not sold.
8.2 Invitations to JackPot friends are delivered within the application. Dinner Party details and invitations to download JackPot sent to your contacts are sent through your device's native messaging application at your direction. JackPot does not independently send messages to your contacts.
8.3 By uploading contact information, you represent that you have the right to provide it to JackPot for the purposes described in this Section. Any individual may request deletion of his or her telephone number from our systems by contacting help@jackpothq.co.
9.1 Allergies, intolerances and certain dietary choices may reveal information concerning your health or religious beliefs and may constitute sensitive personal information or consumer health data under the laws of California, Washington, Nevada and other jurisdictions.
9.2 We collect such information only with your consent and use it solely to personalize meal recommendations and exclude ingredients you wish to avoid. We do not sell such information or use it for advertising, and we disclose it only to service providers that require it to provide the Service. You may modify or delete such information at any time through Profile > Dietary Preferences.
9.3 Residents of Washington and Nevada may request a list of the third parties with which we have shared their consumer health data by contacting help@jackpothq.co.
10.1 Subject to applicable law, and regardless of your place of residence, you may request access to, correction of, deletion of or a portable copy of your personal information. You may also withdraw consent, request that we limit our use of sensitive personal information, and object to or request restriction of certain processing.
10.2 Requests. Requests may be submitted to help@jackpothq.co with the subject line "Privacy Request." We will verify your identity using the email address or telephone number associated with your account and will respond within forty-five (45) days, or within one (1) month where the GDPR applies. You may designate an authorized agent to submit a request on your behalf.
10.3 Appeals. If we decline to act on your request, you may appeal by replying with the subject line "Privacy Appeal." If your appeal is denied, we will inform you of how to contact the Attorney General of your state.
10.4 Account Deletion. You may delete your account within the application or by email request. Uninstalling the application does not delete your account. Subscriptions billed by Apple Inc. or Google LLC must be cancelled through those platforms.
10.5 Communications and Permissions. You may opt out of marketing emails through the unsubscribe link in any such email. Transactional communications, including receipts, will continue to be sent. Notifications and device permissions may be managed through your device settings.
10.6 Non-Discrimination. We will not deny you the Service, charge you a different price or provide a different level of service because you exercise any right described in this Policy.
11.1 During the preceding twelve (12) months, we have collected the categories of personal information set out below, from the sources and for the purposes described in Sections 2 through 4. Each category was disclosed for a business purpose only to service providers. We have not sold or shared any category of personal information, and we have no actual knowledge of selling or sharing the personal information of consumers under sixteen (16) years of age. We use sensitive personal information only for purposes permitted by applicable law.

12.1 JackPot is based in the United States. Personal information is processed in the United States and in other countries in which our service providers operate, which may have data protection laws that differ from those of your jurisdiction.
12.2 Transfers of personal information from the European Economic Area, the United Kingdom or Switzerland are made pursuant to appropriate safeguards recognized by applicable law, including the European Commission's Standard Contractual Clauses. You have the right to lodge a complaint with your local data protection supervisory authority.
13.1 We retain account, dietary, Pantry, Grocery List, recipe, meal and Dinner Party information for as long as your account remains active, and delete or de-identify such information within a reasonable period following account deletion. Payment records are retained for the period required by applicable tax and accounting laws; support communications for as long as reasonably necessary to resolve your inquiry; and diagnostic logs for as long as reasonably necessary to operate and secure the Service.
13.2 We may retain personal information for longer periods where required by law or where reasonably necessary to establish, exercise or defend legal claims.
14.1 We maintain reasonable administrative, technical and physical safeguards designed to protect personal information, including encryption of data in transit, hashed password storage and the processing of payment card data exclusively by our payment processor.
14.2 No method of electronic transmission or storage is completely secure, and JackPot cannot guarantee the absolute security of personal information.
14.3 In the event of a security incident affecting your personal information, we will provide notice as required by applicable law.
The Service is not directed to individuals under eighteen (18) years of age, and users must be at least eighteen (18) years of age to create an account. We do not knowingly collect personal information from individuals under eighteen (18). If we become aware that we have collected such information, we will delete it promptly. Any person who believes that a minor has provided personal information to us may contact help@jackpothq.co.
We may amend this Policy from time to time, and any amendment will be reflected by an updated "Last Updated" date. We will provide notice through the application or by email before any material amendment takes effect and will obtain your consent where required by law. These Terms of Service (the "Terms") constitute a legally binding agreement between you and JackPotHQ LLC ("JackPot," "we," "us" or "our") governing your access to and use of the JackPot mobile application, the website located at jackpothq.co and any related products or services (collectively, the "Service"). By creating an account, subscribing or otherwise using the Service, you agree to be bound by these Terms and acknowledge our Privacy Policy. If you do not agree, you may not use the Service.
These Terms contain provisions that limit our liability and require most disputes to be resolved through binding individual arbitration rather than in court, including a waiver of class actions and jury trials. Please read Sections 14 through 17 carefully.
1.1 You must be at least eighteen (18) years of age to create an account and use the Service, as a valid payment card is required at sign-up. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.

2.3 Recipes, menus and related content are generated automatically, including through artificial intelligence, and are provided as suggestions only. They do not constitute professional culinary, nutritional or medical advice.
3.1 You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
3.2 You must notify us promptly at help@jackpothq.co of any unauthorized access to your account. JackPot is not liable for any loss arising from unauthorized use of your account before you notify us.
3.3 You may delete your account at any time within the application or by email request, as described in our Privacy Policy.
4.1 Plans. The Service is offered on a subscription basis through three tiers: Starter at seven U.S. dollars ($7) per month, Premium at twenty U.S. dollars ($20) per month and Ultimate at twenty-five U.S. dollars ($25) per month. Prices may vary by region and by application store.
4.2 Free Trial. New subscribers may begin a five (5) day free trial, which requires a valid payment card and provides full access to all features included in the Ultimate tier. Unless you cancel before the trial ends, the trial will automatically convert to a paid Starter subscription and your payment method will be charged the Starter price.
4.3 Automatic Renewal. Subscriptions renew automatically at the end of each billing period at the then-current price for your tier unless you cancel before the renewal date. By subscribing, you authorize JackPot or the applicable application store to charge your payment method on a recurring basis until you cancel.
4.4 Price Changes. We may change subscription prices. Where required by law, we will provide advance notice and an opportunity to cancel before a new price takes effect. Continuation of your subscription after a price change takes effect constitutes acceptance of the new price.
5.1 You may cancel your subscription at any time. Subscriptions purchased through an application store must be cancelled through that store. Cancellation stops future charges, and you will retain access until the end of the billing period for which you have paid.
5.2 Except where required by applicable law or the rules of the application store through which you purchased, payments are non-refundable and partial periods are not credited.
6.1 If you download the Service from the Apple App Store or Google Play, your purchase is also subject to that store's terms, including its billing, renewal and refund rules. Where those rules conflict with these Terms with respect to a purchase made through the store, the store's rules shall control for that purchase.
6.2 Apple Inc. and Google LLC are not parties to these Terms and have no obligation to provide maintenance or support for the Service.
7.1 Subject to these Terms, JackPot grants you a personal, limited, revocable, non-exclusive and non-transferable license to use the Service for your own personal, non-commercial purposes. All rights not expressly granted are reserved by JackPot.
8.1 You may submit content to the Service, including pantry items, recipes, photographs, preferences and Dinner Party descriptions ("Your Content"). You retain ownership of Your Content.
8.2 You grant JackPot a worldwide, royalty-free license to use, store, reproduce and process Your Content solely to operate, maintain, improve and personalize the Service in accordance with our Privacy Policy.
8.3 You are solely responsible for Your Content and represent that you have all rights necessary to submit it.
9.1 The Service allows you to invite JackPot friends to your Dinner Party within the application, and to send Dinner Party details and invitations to download JackPot to your contacts through your device's messaging application. You are solely responsible for the messages you send and agree to send them only to individuals who know you and would reasonably expect to hear from you.
9.2 You may block or report another user within the application. JackPot may remove content or suspend accounts that violate these Terms.
9.3 By uploading contact information, you represent that you have the right to provide it to JackPot for the purposes described in our Privacy Policy.

11.1 Recipes, menus, nutrition figures, cook times and ingredient lists provided by the Service are generated automatically and are provided for general informational purposes only. They are estimates and suggestions and are not a substitute for the advice of a qualified professional.
11.2 Although the Service allows you to record allergies and intolerances and attempts to account for them, JackPot does not guarantee that any meal, recipe or ingredient is free of any allergen or suitable for your health needs. Recipes may be incomplete or inaccurate, ingredients vary by brand and supplier, and cross-contamination may occur.
11.3 You are solely responsible for reading every ingredient label, independently verifying that any meal is safe for you and anyone for whom you prepare food, and consulting a physician or registered dietitian regarding your dietary and medical needs. JackPotHQ LLC shall not be responsible or liable for any allergic reaction, illness, injury or other harm arising from any meal, recipe or ingredient suggested by the Service, and you assume all risk associated with the meals you prepare, serve or consume.
12.1 The Service, including its name, logo, software, design, text and overall look and feel, is owned by JackPot or its licensors and is protected by intellectual property laws. Certain aspects of the Service are patent pending. Nothing in these Terms grants you any right in our intellectual property except the limited license in Section 7. You may not use our name or logo without our prior written consent.
13.1 The Service relies on services that JackPot does not control, including hosting providers, payment processors, application stores and artificial intelligence providers. JackPot is not responsible for the acts, content, policies or availability of any third party.
14.1 The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, JackPot disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. JackPot does not warrant that the Service will be uninterrupted, error-free or secure, or that any meal, recipe, nutrition figure or suggestion is accurate, complete or suitable for you.
15.1 To the fullest extent permitted by law, JackPotHQ LLC and its owners, officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of or inability to use the Service.
15.2 To the fullest extent permitted by law, JackPot's total liability for all claims relating to the Service shall not exceed the greater of the amounts you paid to JackPot in the twelve (12) months preceding the claim or one hundred U.S. dollars ($100).
15.3 Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
16.1 You agree to indemnify and hold harmless JackPotHQ LLC and its owners, officers, employees and partners from any claims, damages, losses and expenses, including reasonable attorneys' fees, arising out of your use of the Service, Your Content, the messages you send through the Service or your breach of these Terms.
17.1 These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles.
17.2 You and JackPot agree that any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court where it qualifies.
17.3 You and JackPot each waive any right to a jury trial and agree not to bring or participate in any class, collective or representative action.
17.4 If any part of this Section is found unenforceable, the remainder of these Terms shall continue to apply. Nothing in these Terms limits any mandatory consumer rights you may have under the laws of the country in which you reside.
18.1 You may stop using the Service and delete your account at any time. JackPot may suspend or terminate your access if you breach these Terms, if required by law or if we discontinue the Service. Provisions that by their nature should survive termination shall survive, including Sections 8, 11 and 12 and Sections 14 through 17.
19.1 We may amend these Terms from time to time. We will update the "Last Updated" date and provide notice through the application or by email before any material amendment takes effect. Your continued use of the Service after an amendment takes effect constitutes acceptance of the amended Terms.
20.1 These Terms, together with our Privacy Policy, constitute the entire agreement between you and JackPot regarding the Service. If any provision is held unenforceable, the remaining provisions shall remain in full force. Our failure to enforce any provision shall not constitute a waiver. You may not assign these Terms without our prior written consent; JackPot may assign them in connection with a corporate transaction.
This Consumer Health Data Privacy Policy (the "Health Policy") describes how JackPotHQ LLC ("JackPot," "we," "us" or "our") collects, uses and shares consumer health data in connection with the JackPot mobile application and related services (the "Service"). It is provided pursuant to the Washington My Health My Data Act, Nevada Senate Bill 370 and similar laws, and supplements our Privacy Policy.
